TERMS AND CONDITIONS

 

Compliance with the terms and conditions outlined herein is essential for entry into our yachtyard, ensuring the protection of your yacht and equipment, and most importantly, personal safety. The term 'YachtYard' refers to Rhodes Marinas SA – Yachtyard, 'Vessel' refers to the boat that is lifted and stored, and 'Customer' refers to the owner of the boat or the legally responsible manager of the boat.

 

Safety First 

All persons wishing to enter the yachtyard for any reason, including those authorized to enter, do so at their own risk. The yachtyard assumes no civil or criminal responsibility for accidents or deaths occurring to any persons in or working within the yachtyard at any time. No one is allowed to remain on board any vessel being hauled, moved, or re-propped. Prop stands must not be moved at any time. If you have an issue with the props, please ask for assistance from yachtyard personnel. Raising sails or removing standing rigging is strictly prohibited while yachts are on hard standing. At no time is it permitted for any individual to go aloft on masts or rigging while on yachtyard property. Open fires are prohibited at all times. The customer must not fuel any vehicle or vessel from any place within the yachtyard. Transferring fuel via containers to the tanks of any vessel, vehicle, or internal combustion engine is strictly forbidden, except in areas designated for that purpose by the yachtyard. This must not take place without the express permission of the yachtyard. This clause is an essential term of this agreement. The customer must immediately notify the yachtyard of any damage, accident, or defects in the yachtyard area or the vessel, and repair any damage to the services or the yachtyard area caused by the willful or negligent act of the customer or the customer's associates. Alternatively, the customer must pay the yachtyard the cost of such repairs on demand. Please securely lock your boats and dinghies when left unattended. The yachtyard has no responsibility for any loss of items on the vessel or within the yachtyard.

 

Services & Facilities :

Access to the yachtyard is restricted to the vessel's crew who have the appropriate insurance documentation for the boat. The crew list must be completed at the yachtyard with all necessary insurance documents. Any work without insurance is prohibited within the yachtyard area. Contractors must contact the yachtyard office in advance to work in the yachtyard. Contractor quotations should be sent only by the yachtyard. Before starting any work, written or email confirmation from the owner or captain must be sent to the yachtyard. Warranty issues require appropriate documentation from the brand. Any work on the hull below or above the waterline can  be performed by the yacht’s crew or subcontractor subject to receiving by the yachtyard office a working permit . 

YachtYard working hours are from 07:00 to 17:00. Gate guards have the right to inspect any vehicle entering or leaving the yachtyard. In case of disagreement, entry will not be allowed. Scaffolding services are permitted only by the yachtyard and only with the yachtyard's frames. No hot works are allowed. Outside vehicles are not permitted to enter the work yachtyard area without management's approval.

When access to an electric current supply, whether single or three-phase, is provided by the yachtyard, it will be used by the customer at their own risk. At the yachtyard's request, the customer will make payment for the current reasonably estimated to have been used. The customer must provide all necessary connecting leads, cables, and safety devices, which must be of appropriate size and in good condition.

Unauthorized freelance labor is not allowed at any time. Violation of this rule will result in immediate termination of this agreement, requiring immediate settlement of the current yacht account and immediate launching, regardless of the status of work in progress.

If you need any materials or stores supplied by Al, please ask for assistance from a yachtyard employee and do not attempt to access them yourself. To ensure the accuracy of your account, you will be required to initial all delivery notes before receiving these goods and materials. Power tools are the property of Al Yachtyard and are for the exclusive use of yachtyard personnel. They are not available for rent or loan. All those wishing to carry out work themselves must provide their own tools. Anyone found tampering with yachtyard equipment or materials will be subject to payment of replacement costs, fines, and/or prosecution by local authorities. The position of the vessel in the yard will be decided by yachtyard management and can only be changed in extenuating circumstances. Services and/or hardstand services are provided at the customer's request and are subject to the provisions of this agreement. Spray painting is permitted only by the yachtyard team.

Management requires that all vessels keep their surrounding area clean and regularly collect all debris, placing it in the appropriate containers. Waste oil and other hazardous waste must be declared to the yachtyard before being unloaded from the yacht. Yachtyard management will decide whether it can be received at the waste collection points or if an external service for collection and official certification is needed. Solid urban waste must be placed in the containers supplied by the yachtyard. The yachtyard is not responsible for any pollution of the marine and terrestrial areas by fats and fuels.

 

Payments:

Owners, Captains, or their representatives will receive a hauling invoice before the vessel is hauled. At least 50% of the invoice must be prepaid, and an agreement will be made regarding the schedule and method of payment for the remaining balance. The Customer must settle their entire account as arranged, with the final payment made before the vessel is returned to the water or leaves the yachtyard
